Commission Terms

1. Introduction

By commissioning any services (“Assets”) from Vizion, you (“The Client”) agree to the following terms and conditions (“Terms”):

2. Commission Process

a) Request for Commission:

The Client shall provide detailed specifications and requirements for the Asset, including but not limited to dimensions, style, and any reference materials.

b) Quotation:

Vizion will provide The Client with a quotation based on the provided specifications. The quotation will include the cost, timeline, and other relevant details.

c) Payment:

A deposit of 50% of the total quoted price is required upfront before work commences. The remaining balance is due upon completion of the Asset. Vizion reserves the right to request 100% of the payment upfront at their discretion depending on total project cost.

3. Refund Policy

a) Deposit Refunds:

The initial 50% deposit is non-refundable once work has begun. If The Client cancels before work begins, they are eligible for a full refund of any payments made.

b) Progress-Based Refunds:

If The Client cancels after work has started but before the asset is 50% completed, they may receive a partial refund based on progress made. Once the asset is 50% completed or beyond, no refunds will be issued.

c) Final Payment Refunds:

After full payment and delivery of the final asset, no refunds will be given. If The Client is dissatisfied, they may request revisions within the limits stated in the TOS.

d) Involuntary Cancellation by Vizion:

If Vizion is unable to complete the commission for any reason, The Client will receive a full refund, including the deposit. If the commission is partially completed, The Client may opt for either a partial refund or to receive the unfinished asset as-is.

e) Chargebacks & Disputes:

Any chargebacks or payment disputes will result in an immediate revocation of The Client’s license to use the asset. Vizion reserves the right to pursue legal action for fraudulent disputes.

4. Ownership and License

a) Ownership:

Unless otherwise agreed upon in writing, all rights, including copyright, in the Asset remain the property of Vizion.

b) License:

Upon full payment, Vizion grants The Client a non-exclusive, non-transferable license to use the Asset for personal, non-commercial purposes. Commercial use of the Asset requires prior written consent and may incur additional fees.

c) Crediting:

The Client is not required to credit Vizion but is not permitted to claim the asset as their own creation. Vizion retains all copyright as stated in Section 4.a.

d) AI Training Prohibition:

The Client is strictly prohibited from using the commissioned Asset in any AI training, machine learning models, or automated content generation systems. Any violation of this clause will result in immediate revocation of usage rights and potential legal action.

5. Revisions

a) Initial Revisions:

The Client is entitled to 3 rounds of revisions at no additional cost, provided they adhere to the original specifications.

b) Additional Revisions:

Additional revisions beyond the agreed-upon rounds may incur additional fees, which will be communicated to The Client beforehand.

6. Completion & Delivery

a) Definition of Completion:

A commission is considered complete when the final asset has been delivered to The Client in the agreed-upon format, and any included revisions have been finalized.

b) Delivery Format:

The final asset will be delivered in the format specified during the commission request. Any additional file formats requested after completion may incur additional fees.

7. Confidentiality

Both parties agree to maintain confidentiality regarding all information obtained during the commission process, unless otherwise agreed upon in writing.

8. Liability

Vizion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Asset or these Terms.

9. Termination

Either party may terminate the commission agreement if the other party breaches any of these Terms. In the event of termination, The Client shall compensate Vizion for all work completed up to the termination date. Vizion reserves the right to refuse or terminate a commission at any time if The Client is found to be engaging in fraudulent, abusive, or unethical behavior.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America.

11. Amendments

Vizion reserves the right to modify these Terms at any time. Changes will be posted on the website, and it is The Client’s responsibility to review them periodically.
